You acknowledge that you have purchased the GiraffeG4 System from GiraffeG4 Systems LLC, located at 5 Taxter Road, Irvington NY, 10533. You understand that this product is designed to measure “Low Clearance” objects for tall vehicles, including RVs, ambulances, vans, buses, and trucks, and that it requires the operator to know the exact height of their vehicle.
You acknowledge and agree that it is your responsibility to ensure the accuracy of your vehicle’s height measurement, and to follow all posted signs and warnings. You understand that failure to accurately enter the height of your vehicle may result in inaccurate or incomplete information from the GiraffeG4 System. You also acknowledge and agree that GiraffeG4 Systems LLC is not responsible for any damage or injury that may result from the use of the system, including but not limited to accidents, collisions, or property damage.
You acknowledge and agree that the GiraffeG4 System is an aid to safe driving and is not a substitute for your own judgment and responsibility to operate the vehicle safely. You understand that the GiraffeG4 System may not detect all hazards, and that it is your responsibility to drive safely and to take appropriate precautions based on the circumstances. You also understand that the GiraffeG4 System may require periodic calibration and maintenance to ensure its accuracy and reliability.
You acknowledge and agree that GiraffeG4 Systems LLC, its officers, directors, employees, and agents are not responsible for any personal injury, property damage, or other harm that may result from your use or misuse of the GiraffeG4 System. You understand that the GiraffeG4 System is sold on an “as is” basis, and that GiraffeG4 Systems LLC makes no representations or warranties of any kind, express or implied, regarding the GiraffeG4 System or its performance. You acknowledge that GiraffeG4 Systems LLC assumes no liability for any errors or omissions in the information provided by the GiraffeG4 System or for any damages that may result from the use of such information.
You acknowledge that he GiraffeG4 System includes any of the following parts: the Android GiraffeG4 Sentinel System with Tracking App and tracking hardware, the Android User App, and the iOS User App. These different parts of the GiraffeG4 System may work together, but they may also function independently.
You hereby release and hold harmless GiraffeG4 Systems LLC, its officers, directors, employees, and agents from any and all liability, claims, damages, or expenses arising from your use or misuse of the GiraffeG4 System, including but not limited to personal injury, property damage, or loss of revenue. This release includes any claims based on negligence, breach of contract, or other legal theories, and extends to any third-party claims against GiraffeG4 Systems LLC arising from your use or misuse of the GiraffeG4 System.
You acknowledge that this waiver and release of liability is a binding agreement and that you are voluntarily assuming all risks associated with your use of the GiraffeG4 System. You agree to indemnify and hold harmless GiraffeG4 Systems LLC, its officers, directors, employees, and agents from any and all claims or damages arising from your breach of this agreement or your use or misuse of the GiraffeG4 System.
In the event that any dispute or claim arises out of or relating to the use of the GiraffeG4 System, including but not limited to claims for personal injury, property damage, or breach of contract, the prevailing party shall be entitled to recover from the other party all reasonable costs and expenses incurred in connection with such dispute or claim, including without limitation attorneys’ fees and court costs, regardless of whether the dispute or claim is resolved by settlement, arbitration, or litigation.
You acknowledge that this agreement is governed by the laws of the State of New York and that any legal action arising from or relating to this agreement shall be brought exclusively in the federal or state courts located in the State of New York.
